Commission (Maklerprovision)We agree on the commission (Maklerprovision) in writing before marketing starts. When an apartment or a single-family house is sold to a consumer, the following applies: if both buyer and seller pay commission, they pay the same amount (§ 656c BGB). If the buyer is to take over the seller’s commission, it can be at most half (§ 656d BGB).

How it works.

  1. Meeting and viewing

We get to know the property and clarify your goals: price, timing, discretion.

  2. Price and mandate

You receive a reasoned price assessment and an offer with a clearly stated commission.

  3. Marketing

Exposé, portals or a direct approach to selected buyers, viewings and feedback to you.

  4. Notary and handover

Buyer checks, purchase agreement, notary appointment, handover.

Special sales situations.

Let apartment or let house

With the sale, the tenancy agreement passes to the buyer (§ 566 BGB). We approach investors in a targeted way and present tenancy agreements, rent payments and service charges so that buyers can check the yield. For apartments that were converted into condominiums, we check the tenant’s right of first refusal (§ 577 BGB).

Inherited property and communities of heirs

To sell, the heirs must be entered in the land register or prove their entitlement with a certificate of inheritance (Erbschein) or a notarial will with the record of its opening (§ 35 GBO). If there are several heirs, all of them must agree. We coordinate the process with everyone involved and keep each of them equally informed. More in the article Selling property in a community of heirs (German).

Separation and divorce

If the property belongs to both partners, both must agree to the sale. We market neutrally, inform both sides equally and make sure the price is comprehensible.

Apartment buildings and mixed-use buildings

Here buyers mainly check figures: rent roll, tenancy agreements, costs, maintenance needs. We prepare a data room so that the due diligence runs smoothly and the price is not renegotiated in the final round.

Discreet sale

You do not want your property to appear on the portals? Then we approach selected buyers directly and send the exposé only after a confidentiality commitment.

Commercial property and land

Office, retail and warehouse properties, building plots and commercial land. What counts here is the use, the building law and the tenancy agreements. We clarify these points before marketing starts.

The documents we need.

Whatever is missing, we obtain. The more complete the documents are at the start, the faster buyers decide.

Printable checklist (German)

  • Current extract from the land register (Grundbuch)
  • Cadastral map and site plan
  • Floor plans, calculation of living and usable space

  • For let properties: tenancy agreements, rent roll, utility cost statement

  • Evidence of modernization work

Frequently asked questions

Good to know.

How does a sale with HEPA Immobilien work?

First we get to know the property and clarify your goals: price, timing, discretion. You receive a reasoned price assessment and an offer with a clearly stated commission. Then come the exposé, marketing on the portals or a direct approach to selected buyers, and viewings with feedback to you. Finally we check the buyers, coordinate the purchase agreement with the notary, accompany you to the notary appointment and hand over the property with a written protocol.

What does the valuation cost me?

Nothing. The price assessment is free of charge and non-binding. You receive it personally from the managing directors, as a rule within one working day.

How high is the commission and who pays it?

We agree on the commission in writing before marketing starts. When an apartment or a single-family house is sold to a consumer, the following applies: if both buyer and seller pay commission, they pay the same amount (§ 656c BGB). If the buyer is to take over the seller’s commission, it can be at most half (§ 656d BGB). For other properties such as apartment buildings, commercial property or land, the split is freely negotiable.

How long does a sale take?

That depends mainly on price, location and how complete the documents are. With a price in line with the market and complete documents, buyers are found much faster. After the notary appointment it usually takes a few more weeks until the handover, while the purchase price and the land register are settled.

Which documents do I need for the sale?

For every property a current extract from the land register (Grundbuch), the cadastral map, floor plans with a calculation of the floor area and the energy performance certificate (Energieausweis). For apartments, add the declaration of division (Teilungserklärung), minutes of the owners’ meetings, the budget (Wirtschaftsplan) and the service charge statement (Hausgeldabrechnung); for let properties, tenancy agreements and the rent roll. Whatever is missing, we obtain. Printable checklist (German)

Do I need an energy performance certificate?

Yes, in most cases. The energy performance certificate (Energieausweis) must be shown to prospective buyers at the latest at the viewing, and if one exists, its key figures belong in the listing (§ 80 Abs. 4, § 87 GModG, formerly GEG). Exceptions apply, for example, to listed buildings. If the certificate is missing, we arrange it.

Is the sale subject to tax?

For privately held property, a gain can be taxable if less than ten years have passed between purchase and sale (§ 23 EStG, often called speculation tax, Spekulationssteuer). As a rule, this does not apply to property you lived in yourself in the year of sale and the two previous years. Please clarify this with your tax advisor before the sale; we do not provide tax advice.

Can I sell while I still live in the property?

Yes. We agree on viewings with you, and we set the handover date in the purchase agreement so that it fits your move.
