Selling a house

Selling a house, thoroughly prepared.

Single-family house, semi-detached house, terraced house or villa. With a house, the plot, the building fabric and the energy condition determine the price at least as much as the living space.

What is different with a house

Whoever buys a house buys the plot as well.

With a house, buyers and banks look at more than the rooms. They ask about the plot boundaries, access and public easements (Baulasten), and whether extensions, the garage, a conservatory or a converted attic have been approved. The answers come from the cadastral map from the surveying office, the register of public easements (Baulastenverzeichnis) and the building file at the district office.

The energy performance certificate (Energieausweis) carries more weight for a house than for an apartment, because the buyer alone bears the heating, roof and windows. If a certificate exists, its key figures belong in the listing (§ 87 GModG, formerly GEG). For houses with fewer than five apartments whose building application was submitted before 1 November 1977, a demand-based certificate (Bedarfsausweis) is generally required, unless the building reaches the level of the 1977 Thermal Insulation Ordinance (Wärmeschutzverordnung).

Besides living space and condition, the price depends above all on plot size and location. For owner-occupied houses, valuers often look at the building fabric, supplemented by comparable prices. You can look up the standard land value (Bodenrichtwert) for your location yourself on the BORIS Berlin portal. More in the article Property valuation in Berlin (German).

Which houses we sell.

  • Single-family houses
  • Semi-detached and terraced houses
  • Two-family houses, including those with a granny flat
  • Villas and town houses
  • Houses on large plots
  • Inherited houses and houses owned by communities of heirs

What we take care of.

Plot and building law

  • Checking the land register, cadastral map and register of public easements
  • Clarifying permits for extensions, garage and attic conversion
  • Putting the standard land value and plot size into context

House and energy

  • Viewing with a focus on roof, heating, windows and cellar
  • Arranging the energy performance certificate if it is missing
  • Compiling modernization work with receipts

Marketing and closing

  • Photos, floor plans and exposé
  • Viewings with a preselection, scheduled around your daily life
  • Financing checks of the buyers, notary appointment and handover with a written protocol
Commission (Maklerprovision)We agree on the commission (Maklerprovision) in writing before marketing starts. When an apartment or a single-family house is sold to a consumer, the following applies: if both buyer and seller pay commission, they pay the same amount (§ 656c BGB). If the buyer is to take over the seller’s commission, it can be at most half (§ 656d BGB).

How it works.

  1. Viewing

We look at the house and the plot and clarify your goals: price, timing, moving-out date.

  2. Price and documents

Reasoned price assessment, offer with a clearly stated commission, documents from the land register to the energy performance certificate.

  3. Marketing

Exposé, portals or a discreet approach, viewings and feedback to you.

  4. Notary and handover

Financing check, purchase agreement, notary appointment, handover with meter readings and keys.

Typical situations when selling a house.

You still live in the house

We schedule viewings so that they fit into your daily life. We set the handover date in the purchase agreement so that you can move in peace.

Older house in need of modernization

Buyers deduct upcoming work from the price. We compile what was renewed and when, so that the negotiation is based on receipts and not on estimates.

Extension without a permit

This needs to be on the table before marketing starts. We look at the building file and discuss with you how the point is presented openly in the exposé and in the purchase agreement. Whether a retrospective permit is possible is clarified by an architect with the building supervisory authority.

Inherited property and communities of heirs

To sell, the heirs must be entered in the land register or prove their entitlement with a certificate of inheritance (Erbschein) or a notarial will with the record of its opening (§ 35 GBO). If there are several heirs, all of them must agree. We coordinate the process with everyone involved and keep each of them equally informed. More in the article Selling property in a community of heirs (German).

Separation and divorce

If the property belongs to both partners, both must agree to the sale. We market neutrally, inform both sides equally and make sure the price is comprehensible.

Discreet sale

You do not want your property to appear on the portals? Then we approach selected buyers directly and send the exposé only after a confidentiality commitment.

The documents we need.

Whatever is missing, we obtain. The more complete the documents are at the start, the faster buyers decide.

Printable checklist (German)

  • Current extract from the land register (Grundbuch)
  • Cadastral map (extract from the real estate map)
  • Floor plans, sections and calculation of the living space
  • Building permit and building specification, if available
  • Energy performance certificate (Energieausweis)
  • Evidence of modernization of roof, heating, windows and pipes
  • Information from the register of public easements (Baulastenverzeichnis)
  • Passport or ID of the owners (identification duty under the German Anti-Money Laundering Act, Geldwäschegesetz)

Frequently asked questions

Good to know.

How is the price of a house determined?

We look at the house and the plot and compare them with sales in the area. Besides comparable prices, what counts for houses is the building fabric, that is year of construction, condition and modernization, as well as the land value. The price assessment is free of charge and non-binding and comes personally from the managing directors.

Do I need an energy performance certificate?

Yes, in most cases. The energy performance certificate (Energieausweis) must be shown to prospective buyers at the latest at the viewing, and if one exists, its key figures belong in the listing (§ 80 Abs. 4, § 87 GModG, formerly GEG). Exceptions apply, for example, to listed buildings. If the certificate is missing, we arrange it.

How high is the commission and who pays it?

We agree on the commission in writing before marketing starts. When an apartment or a single-family house is sold to a consumer, the following applies: if both buyer and seller pay commission, they pay the same amount (§ 656c BGB). If the buyer is to take over the seller’s commission, it can be at most half (§ 656d BGB). For other properties such as apartment buildings, commercial property or land, the split is freely negotiable.

How long does a sale take?

That depends mainly on price, location and how complete the documents are. With a price in line with the market and complete documents, buyers are found much faster. After the notary appointment it usually takes a few more weeks until the handover, while the purchase price and the land register are settled.

What if an extension has not been approved?

This should be clarified before marketing and presented openly. We look at the building file at the district office and discuss with you how the point is dealt with in the exposé and in the purchase agreement. Whether a retrospective permit is possible is clarified by an architect with the building supervisory authority.

Can I sell while I still live in the property?

Yes. We agree on viewings with you, and we set the handover date in the purchase agreement so that it fits your move.

Is the sale subject to tax?

For privately held property, a gain can be taxable if less than ten years have passed between purchase and sale (§ 23 EStG, often called speculation tax, Spekulationssteuer). As a rule, this does not apply to property you lived in yourself in the year of sale and the two previous years. Please clarify this with your tax advisor before the sale; we do not provide tax advice.
